The term β€˜Company’, β€˜Ecozen Group’, β€˜We’, β€˜Us’ and β€˜Ours’ shall include any other subsidiary or affiliates (as defined under the Indian Companies Act, 2013) of Ecozen and Ecofrost and this Privacy Policy applies to in respect of usage of the Website by/on behalf of the said entities as well.

This Privacy Policy does not apply to the websites of our business partners, corporate affiliates or to any other third parties, even if their websites are linked to the Website. We recommend you review the respective privacy statements of the other parties with whom you interact.

By accessing the Website or otherwise using the Website, you (hereinafter referred to as β€œYou”, β€œYour”, β€œUser”, β€œGuest/s” as applicable) expressly consent to Our collection, storage, use and disclosure of the Information (as defined hereunder) in accordance with the terms of this Privacy Policy.

As We update, improve and expand the Website, this Privacy Policy may change at Our sole discretion, and such changes will be notified via our Website and/or, where required, via direct communication. Geo-Location Data (IoT Devices):

Our Internet of Things (IoT) enabled products and services may collect and process Your geo-location data associated with the device and/or the User, including but not limited to GPS, approximate/cell-based location, Wi-Fi/Bluetooth proximity, timestamps, route history, any location-linked device/account identifiers and others. The afore-listed geo-location data are a part of Personal Information as used in this Privacy Policy and all provisions of the Privacy Policy applicable to such Personal Information shall apply to the data collected under this Paragraph without any modifications or variations.

You hereby provide Your express and free consent for collection of through any of Our products which may include software, applications or any hardware devices being used by You to access one or more of Our products or services and you understand that such information is critical for the use of Our products or services, including the IoT enabled products and services, at their fullest extent and for availing all functionality, and such collection is undertaken for, including but not limited to, the following specific purposes:

  • enabling device location and tracking features requested by the User;
  • supporting safety and security functionalities of the device; and
  • facilitating service delivery, including diagnostics and maintenance of the device, required for allowing continued access to Our products and improving its performance, which may include data used for business analytics and such other purposes, in a manner not enabling the identification of Your Personal Information and with appropriate privacy and data protection measures.

We ensure that:

  • Where feasible, You are provided with controls to enable, disable, or limit location tracking features and You understand that, in case You disable the location or tracking features, You will not be able to access any functionality of Our product or services that requires such data for its operation and its performance may be subjected to certain limitation arising due to non-availability of such data;
  • Appropriate technical and organisational safeguards are implemented to secure geo-location data against unauthorised access, disclosure, alteration, or loss;
  • Geo-location data is retained only for as long as necessary to fulfil the stated purposes or as required under Applicable Law and for enabling the products or services availed by You and is securely deleted thereafter, as per the Applicable Law;
  • We do not engage in continuous or background tracking of user location beyond what is necessary for the functioning of the IoT product or as expressly consented to by the user, as per this Privacy Policy; and
  • We do not sell or share geo-location data with third parties except where necessary for service delivery (such as cloud hosting, data processing units or analytics providers) or where required by law.

Further, You as a User of Our product and services, have the right to access, correct, and request erasure of their geo-location data, to withdraw consent at any time, and such other rights as provided in Paragraph 9 (Rights of Users and Consent Management) of this Privacy Policy and in accordance with Applicable Law. You hereby understand and acknowledge that withdrawal of consent may result in limited or restricted functionality of certain features of the IoT product or service and in certain cases, may affect the performance and operation of Our products or services.

USE OF INFORMATION

We do not sell, trade, or otherwise transfer to third parties Your Information. This does not include trusted third parties who assist Us in operating Our Website, conducting Our business, or servicing You. We may also release Your information when We believe release is appropriate to comply with the law, enforce Our Website policies, or protect Ours’ or others’ rights, property, or safety.   • Your information, whether public or private shall be used to analyse and suggest any other related product/service that shall be suitable for you; and/or

However, Your decision to withdraw Your consent will not affect the processing of Personal Information based on Your previous consent as provided under Paragraph 9 (Your Consent) of this Privacy Policy. We will make endeavours to respond to your request within a reasonable period of time and in accordance with the Applicable Law.

In case of any physical/mental incapacity, death or any other legitimate reason, You may exercise the aforesaid right by way of nominating a representative for the same.

Depending on the circumstances and the nature of Your request it may not be possible for Us to do what You have asked, for example, where there is a statutory or contractual requirement for Us to process Your data and it would not be possible to fulfil Our legal obligations if We were to stop.

Where You have consented to the processing, You can withdraw Your consent at any time by emailing the Grievance and Data Protection Officer. In this event, We will stop the processing as soon as such processing is no longer necessary for the provision of the Products/Offerings. In addition to the above, in the event You are registering for our Solar Hero programme, Ecozen Partner programme or such other programmes offered by Us, You may be required to share your (i) Aadhar number and details, permanent account number, photographs, specimen signatures and limited identity information and (ii) such other details including but not limited to your bank account details and supporting documents for the sole purpose of enabling the products, services and offerings provided by Us under the said programmes. You hereby explicitly provide your free and express consent to the provision of the said information and for usage, access, processing, limited transmission, storage and retention of the said information to a recognised third party for the purpose of enabling such services as captured here. All such information collected are stored, processed, collected, etc. in accordance with the Applicable Law.

Any information with respect to Aadhar details and identify information and photographs collected as per the Aadhaar Act is for the sole purpose of authentication and Know Your Customer (β€œKYC”) verification of User’s identity for the purpose of making available its products, offerings, features and others services, and are strictly carried through authorised entities under Aadhar Act and rules and regulations thereunder. We do not in any manner transfer, share, enable access, storage or retention of Your Aadhar and identify information in any manner whatsoever, whether physically or virtually, nor provide access to any third party except to the extent required for the purpose of enabling the KYC verification and authentication, in accordance with the Aadhar Act.

INTERNATIONAL DATA TRANSFERS

Where your Personal Information is transferred outside your respective jurisdiction, we ensure adequate safeguards are in place as prescribed under the applicable laws, including through data transfer agreements and government-mandated restrictions.
